These Terms and Conditions set out the rules for accessing and using Kshana API and related services provided by Firetminds Private Limited.

Acceptance of Terms
These Terms and Conditions govern access to and use of Kshana API, our website, our hosted application, and related services provided by Firetminds Private Limited. By accessing or using the service, you agree to these terms on behalf of yourself or the business you represent.
If you are using Kshana API for an organization, you represent that you have authority to bind that organization to these terms.
Service Description
Kshana API is a business software platform for WhatsApp-first communication workflows, including shared inbox operations, contact and lead management, campaigns, templates, analytics, and related collaboration features.
Some features depend on third-party platforms, including Meta and the WhatsApp Business Platform. Continued availability of those features may depend on those third-party services, approvals, policies, and technical limitations.
Accounts and Customer Responsibilities
You are responsible for maintaining the confidentiality of account credentials, limiting access to authorized users, and ensuring that information submitted through your workspace is accurate and lawful.
You are responsible for obtaining all permissions, notices, and consents required for your collection and use of contact data, message content, and other information processed through Kshana API.
You must comply with applicable laws, regulations, Meta platform requirements, WhatsApp Business messaging rules, and anti-spam or consumer protection obligations relevant to your use of the service.
Acceptable Use
The additional rules in our Acceptable Use Policy form part of these Terms.
You may not use Kshana API to send unlawful, deceptive, infringing, abusive, harassing, discriminatory, or spam content, or to violate privacy, data protection, export control, or intellectual property laws.
You may not interfere with the service, attempt unauthorized access, reverse engineer restricted portions of the platform except where legally permitted, or use the service in a way that could harm Kshana API, our systems, or other users.
We may suspend or restrict access if we reasonably believe your use creates legal, security, reputational, or operational risk.
Third-Party Services
Kshana API may interoperate with Meta, WhatsApp Business Platform, and other third-party providers. Your use of those services remains subject to their own terms, policies, and technical requirements.
We are not responsible for outages, policy decisions, content review outcomes, access restrictions, pricing changes, or functionality changes imposed by third-party providers.
Subscriptions, Trials, Billing, and Taxes
Plans may be offered monthly or annually and may include a trial period. Plan features, limits, prices, taxes, renewal dates, and payment requirements are shown during signup, plan selection, checkout, or within the billing area. Unless stated otherwise, paid subscriptions renew for the selected billing cycle until cancelled or changed.
You authorize the applicable payment provider to process each charge you confirm in checkout. Saving masked payment metadata does not authorize recurring debits. Invoices must be paid by their stated due date, and access may be restricted after a trial ends, after a payment grace period expires, or while an amount remains overdue.
Meta and WhatsApp messaging charges may be billed separately from Kshana API subscription fees. You are responsible for applicable taxes, provider charges, and accurate billing information. Fees already earned are non-refundable except where required by law or expressly agreed in writing.
WhatsApp Messaging and Consent

You are responsible for obtaining and retaining valid recipient permission, using templates for their approved purpose, honoring opt-out requests without delay, and complying with the customer service window and all applicable Meta, WhatsApp, anti-spam, privacy, consumer-protection, and regulated-industry requirements.
Kshana API provides consent records and message restrictions to support responsible operation, but those controls do not replace your legal review or responsibility for the audience, content, timing, purpose, and lawfulness of each communication.
Data and Privacy
Our handling of personal information is described in our Privacy Policy.
You retain responsibility for the business data and user content you or your users submit to Kshana API, subject to the rights you grant us to host, process, transmit, and display that data as necessary to operate the service.
Intellectual Property
Kshana API, including its software, design, branding, documentation, and related materials, is owned by Firetminds Private Limited or its licensors and is protected by applicable intellectual property laws.
Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the service for your internal business purposes.
Availability and Changes
We may modify, enhance, suspend, or discontinue features at any time, including where required for maintenance, security, legal compliance, or third-party dependency changes.
We will use reasonable efforts to keep the service available, but we do not guarantee uninterrupted or error-free operation.
Support and Security
Product support and public escalation channels are described on our Support page. Customers must promptly report suspected compromise, unauthorized messaging, exposed credentials, or security incidents and cooperate with reasonable protective actions.
You remain responsible for authorized-user reviews, secure devices, credential confidentiality, integration configuration, contact consent, data exports, and business-continuity measures appropriate to your operations.
Disclaimers
To the maximum extent permitted by law, Kshana API is provided on an as available and as is basis. We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
Limitation of Liability
To the maximum extent permitted by law, Firetminds Private Limited will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunities arising from or related to the use of Kshana API.
To the extent liability cannot be excluded, our aggregate liability will be limited to the amount paid by the customer for the service during the twelve months preceding the event giving rise to the claim.
Termination
You may stop using the service at any time. We may suspend or terminate access where required by law, for security reasons, for non-payment, for policy violations, or where continued service is no longer commercially or technically feasible.
Provisions that by their nature should survive termination will survive, including provisions relating to intellectual property, disclaimers, liability limits, payment obligations, and dispute-related terms.
Account Data After Termination
Permanent deletion requests must follow our Data Deletion Instructions.
Termination or account deactivation does not automatically constitute a verified deletion request. Data may be retained or deleted according to the Privacy Policy, Data Deletion Instructions, backup cycles, customer instructions, contractual requirements, and applicable law.
Changes to These Terms
We may update these Terms and Conditions from time to time. The updated version will be posted on this page with a revised effective date. Continued use of the service after the effective date constitutes acceptance of the updated terms.
